What is retail fraud?

Retail fraud is a crime committed by an individual or groups against a business that offers items for sale. Such crimes relate to obtaining merchandise without paying for the item, fraudulently returning items to obtain an undue refund, or otherwise defrauding retail establishments of their rightful revenue.


Is retail fraud a felony?

Retail fraud in the first degree is classified as a felony. Retail fraud in the second or third degree are classified as misdemeanors. Offenders with prior retail fraud or larceny convictions face enhanced penalties.
